
A division bench on Tuesday, comprising Chief Justice Maqbool Baqar and Justice Shahnawaz Tariq, passed this order while announcing their verdict, which was reserved earlier after hearing arguments from the millers, the federal and provincial authorities earlier this month.

The millers had approached the court seeking an effective mechanism for the fixation of sugar prices and questioning legality of Section 16 of Sugar Factories Control Act-1950 regarding fixation of minimum sugarcane prices.
During the course of the proceedings, spanning over weeks, the court granted opportunities to the representatives of millers, sugarcane growers and the relevant departments to reach a consensus on the issue. They failed, however, every time.
In their verdict, the judges observed that as regards the submission that the petitioners were through the notification dated December 3, induced to purchase the sugarcane and commence the crushing and this promissory estoppels now operates in favor of the petitioners.
