Style snafu: Petitioner victorious in suit

Asked for a two-button suit but was given a three-button one instead.

The Consumer Court, on Monday, directed the owner of Dee Jays Designer to pay Rs9,000 in a case seeking damages of Rs34,000 for stitching a defective suit.


Petitioner Mian Zulqarnain told that court that on February 11 he gave cloth to Aftab Alam Chishti, owner of Dee Jays Designer on Link Road, Mughalpura, to stitch a two-piece suit. He said that he had instructed Chishti to stitch the suit in the three-button style. February 18 was set as the date of delivery of the suit, he said.

The petitioner said that on February 18, when he went to pick up his suit, he found out that the suit had been stitched in the two-button style. He added that the suit was also not the right size. The petitioner said that the respondent assured him that he would have all the defects corrected and the suit would be ready in three days’ time.

However, the petitioner said, the suit was not ready in three days and the date of delivery kept moving forward till the respondent on March 16 refused to remove the defects.

Zulqarnain sued the respondent and asked the court to direct Chishti to pay him Rs4,000 for the price of the cloth, Rs15,000 as damages and Rs15,000 as legal expenses. On an earlier date, the respondent had appeared in court and said he would submit a written reply at next hearing.  However, the respondent was absent from court and the court moved ex-parte on the matter.

The judge passed an order on Monday directing the respondent to pay Rs4,000, the price of the cloth and Rs5,000 in compensation and legal expenses.
