Three-year-old named in criminal case granted bail

Police probe carries flaws as toddler was accused of issuing death threats, forcibly entering a house

Court grants bail to three-year-old boy who was booked in a criminal case

KARACHI:

Additional District and Sessions Judge Malir, Zulfiqar Memon, on Wednesday granted bail to a three-year-old boy who was booked in a criminal case.

The toddler was named in a criminal case of being involved in issuing death threats, forcibly entering a house, harassment, and theft, exposing flaws in police investigation. The judge also granted bail to the child’s three elder brothers who were also named in the case.

During the hearing at Malir Court, the accused brothers — Muhammad Lal, Qari Mir Khan and Attaullah — appeared alongside the three-year-old Rahimullah, who was also listed as a suspect.

Defence counsel Atta Muhammad Khan Advocate, presenting the child before the court, said: “I am bringing before you a dangerous criminal, accused of issuing death threats and stealing Rs90,000 along with heavy equipment.”

He then pointed to the toddler in his arms, leaving the courtroom astonished. The judge expressed disbelief, questioning how a child of such age could possibly commit such criminal acts.

The defence argued that the case was registered under court orders but claimed the allegations were fabricated, possibly due to personal enmity. According to the FIR, Rahim was accused of assisting his brothers in stealing a generator and heavy pipes.

The court observed that it was regrettable the police had nominated a minor child in such a case, remarking that had his age been considered, such an error would not have occurred. The defence also noted that the other three brothers live in Quetta but were nevertheless implicated in the same case.

The judge approved interim bail for Rahim against surety bonds of Rs5,000, while his three brothers were granted bail on Rs10,000 bond each. The court summoned the investigating officer along with the case file at the next hearing on September 15.
