The Constitutional Bench of the Supreme Court on Wednesday allowed the PTI to file a new petition against amendment to the Election Act.
The six-member bench, led by Justice Aminuddin Khan, heard various cases. When the hearing of the case against the second amendment to the Election Act began, PTI's lawyer Suleman Akram Raja said that there was also a matter of the admissibility of the petition.
He said that he wanted to file a new petition on the objections of the Registrar's Office. Justice Jamal Khan Mandokhail told the lawyer that if he had filed the new petition earlier, the court's time would not have been wasted. Later, the court allowed the re-filing of the petition.
When the hearing began on the issue of giving right to appeal to the employees of the high courts against administrative decisions, the petitioner's lawyer said that the question before the bench was that where would the appeal go.
Justice Muhammad Ali Mazhar said that it was the responsibility of the high courts to make rules. The lawyer said that the rules were being framed only by the Islamabad High Court (IHC). The court sought a response from the Peshawar High Court (PHC) and the IHC in 10 days.
During the hearing of the Royal Palm Club case, the additional attorney general (AAG) informed the court that 11 companies had shown interest, but only one company offered the bid for the Palm Club. He added that a report would be submitted to the court after finalising the bidding.
During the hearing, Justice Mandokhel remarked that when institutions did not work, a vacuum was created; therefore, every institution should do its own work. Justice Aminuddin Khan said that deviating from the Constitution and the law was tantamount to failing the Constitution and the Law.
