Law Minister Azam Nazeer Tarar has said that the court has confirmed in its decision that the Punjab governor's action is constitutional, and morally the assembly will be dissolved by the chief minister who has the majority.
Reacting to the decision of the Lahore High Court (LHC), Tarar said that Chaudhry Pervaiz Elahi did not want to take a vote of confidence because he lacks 186 votes.
Terming it as a “heavy day”, he said that he did not want to speak without reading the court's order.
The law minister said that this is the constitutional right of the governor, which has been repeatedly confirmed by the court. “Morally, the chief minister who has the majority will dissolve the assembly,” he said. “It is certain that the chief minister did not have the majority.”
The law minister said that the court has given “Elahi a life-saving injection” for a few days, and the governor has the authority to ask the chief minister for a vote of no confidence and the chief minister is also bound to obey this order.
“Time is very short,” he remarked.
Tarar said that the court stopped Elahi from dissolving the assembly until January 11, and Speaker Sibtain Khan had also called a meeting.
On the other hand, speaking on a private TV programme, Interior Minister Rana Sanaullah said the court had given interim relief to Elahi and had bound him not to take any unconstitutional steps.
He said that from January 11, the court would give a decision after listening to both the parties.
“I believe that Pervaiz Elahi will have to take a vote of confidence on the court’s decision,” he said. “Now, it is his will to continue the assembly or dissolve it.”
