LHC directs police to return vehicle to owner in 48 hours

Section 95 of the ordinance dictates that the vehicle shall be returned without unnecessary delay

LAHORE: The Lahore High Court (LHC) Justice Tariq Saleem Sheikh on Friday ordered the police to honour the Provincial Motor Vehicles Ordinance 1965 and return the accident vehicle to the petitioner.

The petitioner had contested that the collision took place due to the negligence of the car driver and argued that the respondents could prosecute the bus driver, Muzammil Hussain, but had ‘no authority’ to detain the bus. The bus had been involved in an accident with a car at Laiser Kalan injuring the car driver in the mishap.

Section 95 of the ordinance dictates that the place to which the vehicle is removed shall be intimated to the owner of the vehicle and it shall be returned without unnecessary delay.

The ordinance also states a 48-hour deadline for the return of the vehicle after inspection.
