Alleged serial rapist Muhammad Ali Hajano, who was booked in about 33 cases of armed dacoity among others, got bail in two cases on Monday after his lawyer presented a strong case.
Justice Imam Bux Baloch heard the criminal bail application Nos. 224 and 225 of 2011. The complaint was lodged by Dr Sonia Poshi of Civil hospital’s skin department. She alleged that on May 11, 2008 she was going to her mother’s house with her daughter at about 11 pm when Hajano, in a white car, snatched her purse which had documents, a CNIC and other valuables in Defence precincts. Hajano’s lawyer Jamal A Mufti submitted that nothing was recovered from his possession. No identification parade was held either.
Hajano was not nominated in the FIR, nor was his description given in the case FIR. His lawyer relied on a judgment by the SC Farman Ali versus the State, 1997. Assistant Prosecutor General Iqbal Ahmed Awan had no counter arguments. The bench noted that Awan conceded that the investigating officer did not find anything on Hajano and no identification parade was held. The bench then admitted Hajano to bail in two identical cases for Rs50,000 each.
