Same rules don’t apply: LHC stays tax recovery from WAPDA
The court also sought a reply from the Excise and Taxation Department by December 10

LHC on Thursday suspended recovery of Rs1.3 million property tax from four WAPDA offices on a petition filed against it. The court also sought a reply from the Excise and Taxation Department by December 10. Justice Syed Mansoor Ali Shah passed the order on a petition filed by WAPDA challenging the imposition of property tax. WAPDA’s counsel Umar Sharif told the court that the Excise and Taxation Department had issued notices for payment of Rs1.3 million property tax to four WAPDA offices and residential flats. He said the federal government was exempted from property tax under Article 165 of the Constitution. He said WAPDA, being part of the government, was also exempted from property tax. The counsel said the notices were illegal and asked the court to set them aside.He asked the court to suspend recovery of the property tax till a final ruling was made on the case.
