Expats problems: SC adjourns CAA case for two weeks
The court adjourned till June 29.
ISLAMABAD:
The country’s top court on Friday adjourned hearing of a case with regard to problems being faced by overseas Pakistanis at airports for two weeks due to non-availability of the counsel for Civil Aviation Authority (CAA).
The court also directed the authority to submit a letter mentioning the reasons for making CAA Director Commercials Asif Bashir ‘officer on Special Duty’ (OSD).
A two-judge bench of the apex court, headed by Justice Jawwad S Khawaja taking up a complaint filed by Bashir on Thursday asked the counsel for CAA whether any charge-sheet was issued to him before making him an OSD.
The CAA Director General (DG) Muhammad Yousuf in his reply informed the court that Bashir was made OSD for ten days in accordance with rules and regulation and in compliance with all principles laid down in Anita Turab case judgment.
He said that Bashir was posted to Balochistan on May 30 but he refused to abide by the order.
“The complainant acting in a mala fide manner has also attempted to raise a number of other issues levelling baseless allegations against the management,” the DG added in his reply.
The reply also submitted that Bashir being the president of Inter-Departmental Committee has admitted his failure to complete an inquiry on the SC’s orders. “It was on account of such failure that the Aviation Division has sought a written explanation from him.”
Meanwhile, Justice Khawja also observed that they do not want to widen the scope of the case as their only focus is to resolve the problems of overseas Pakistanis that they face at the airports.
The applicant submitted that on May 6 he was asked to prepare a report regarding the establishment of fuel farm and operation and maintenance of hydrant re-fuelling system at new Islamabad airport for the approval of Executive Committee prior to its submission to CAA Board. “This was a matter of concern for the higher management and I was asked to change its detrimental to the interest of CAA, which I politely declined”
The court has directed CAA counsel Khalid Mahmood Siddiqui to submit the minutes of CAA executive committee and approval of CAA Board on the issue of fuel farm facility. The hearing was adjourned till today.
The same bench has issued notices to federal and provincial governments to explain why its December 27 judgment related to monitoring of social welfare obligations of oil exploration and production companies was not being implemented.
The court adjourned till June 29.
