A bench of the apex court will take up this case on June 16 on the request of the federal government.
In the appeal, the government has requested to suspend the SHC's decision. It has asked the Supreme Court to stop Musharraf from traveling abroad.
The federation insisted that Musharraf will not return to Pakistan once he leaves the country, which will bring his trial, which is at an advanced stage, to a standstill.
On June 12, the SHC had ordered the removal of Musharraf’s name from the ECL but had suspended this order for around two weeks, giving the federal government time to appeal against the decision before the Supreme Court.
Following the high court’s order, Musharraf filed a petition in the SHC requesting permission to leave the country at the earliest to visit his ailing mother.
However, the petition reads that the federal government offered to fly in Musharraf's mother from the UAE, but the former president refused as he wants to avoid the trial and leave the country.
It further states, “It is further prayed that during the pendency of the instant petition the impugned judgment may kindly be suspended and the name of the respondent may kindly continue to remain on the ECL and he may be restrained from going abroad without the permission of this honorable court.”
The former president is involved in 12 cases and faces treason charges for subverting and circumventing the Constitution by imposing emergency on November 3, 2007. The federal government had placed his name on the ECL, stating he might try to abscond.
Facts
The federal government’s petition also mentioned instances regarding Musharraf’s conduct to convince the court to not allow him to travel abroad. These facts were similar to the ones stated by Prime Minister Nawaz Sharif on many occasions against the former president.
The respondent is a former chief of army staff and, thus, is responsible for the overthrow of an elected government on October 12, 1999 and for imposing martial law in the country.
Subsequently, he took office as president of Pakistan by removing a lawfully-elected president, Muhammad Rafique Tarrar. Later on, the respondent got himself elected as president of Pakistan from a parliament that was elected through general elections held in 2002-2003.

I request SC to show some mercy towards this coward. There is no point to punish a person who cannot stand up like a man.
If you started the trial back when he was arrested the question of bail would be mute. Never too late - stop the drama and start the trial.

In my humble opinion the government made the right decision by going to the Supreme Court against SHC order. This should give the judicial system a chance to prove to the common Pakistani that the law is not only for the poor & weak.
If Musharraf & his well wishers think he is innocent he should face the trials & prove to the world that he is a commando, brave & believe in the judicial system of justice of the country he ruled for 8 years. He will be a hero if he faces the trial & a cowered if he fleas. I hope he chooses to stay & be a man & prove to the world that he is brave soldier & commander of one of the finest armed forces in the world. This would be his great service to the great Army of Pakistan.

I was never a Musharaf's supporter but having seen the 2 most corrupt political leaders ie Nawaz and Zardari, I now feel that Musharaf must have done something right that these corrupt politicians did not like. Also the comments in this and other forums are generally very supportive of Musharaf. So I am a convert and support Musharaf to kick these corrupt politicians out of our country.

its not matter of being in ECL or not, most officials and politicians are offered good in return for yelling, the communities must resolve their issues with their counter parts instead of yelling and gaining sympathies, politicians must not exploit these situation to polish instead they must concentrate on their obligations instead of blaming institutions and countries, matters of a true investigation by sensible and responsible individuals not a media or public matter, some nations are in habit of prolonging issues without updating laws and procedures necessary for the time and through filth and blame on others, puppets of sponsors.

Nawaz Shareef should move on. Do something for the people of Pakistan. By punishing Gen. Mushraf what he is going to achieve, nobody is paragon of virtue in Pakistan.

useless to pursue Musharaf when Pakistan is currently embroiled in ton of other important issues! will we get electricity, jobs, peace of mind etc if we convict Musharaf? He should proudly face the courts and let due process and justice exonerate him honorably. People calling this vendetta, had it been the case the special courts would have dispensed speedy justice a long time ago and Musharraf would either be wilting in a dungeon at Attock Fort or would have been sentenced to death by now.

Its a test for the government for it is under extreme pressure by the security establishment and by extension its proxies like IK, Tully, Qadri and Chaudries. But the government should make sure that no matter what happens, Musharraf should not be let go at any cost.

Pakistan is the exemplary failed state in the entire history of the world. And the credit of its Nation and State failure goes to Army. The army, agencies and institutes has fail the Pakistan. They destroyed Pakistan, Afghanistan and peace and stability in the regions for decades. Today the region and country and nation in the worst crisis and disasters is just because of army and agencies. Bombing innocent people, earning dollars, target killings, torturing, kidnapping, suppression, trading, smuggling, human trafficking, ethnic and sectarian division and using innocent young and immature kids for own agenda against both foe and friends are the main characteristics of army and its agencies.

This decision at a time, when the government had a great opportunity to let it go and move to more pressing matters, speaks volumes of the sheer stupidity and/or the state of the mind of NS... By continuing on the path of confrontation NS is proving all the people right who say he has learnt nothing after his 2 precious spells and the long hiatus.
