Innocent until…: Sessions judge to probe alleged explosives case

If the case was wrongly registered, legal action will be taken against police, added the court.

The Peshawar High Court (PHC) directed a sessions judge to look into the case of an accused who had allegedly been arrested with explosives. If the case was wrongly registered, legal action will be taken against police, added the court.


The order was issued by a two-member division bench comprising Chief Justice Dost Muhammad Khan and Justice Musarat Hilali after Muhammad Hamayun’s counsel shared Humayun’s cousin Fazal Shah was illegally arrested by Khazana police station officials.

A Khazana police official informed the court the accused was arrested with explosive jackets and an FIR had been registered against him on July 23 under the Explosive Substances Act, 1908 and Section 7 of the Anti-Terrorism Act.

The court transferred the case to the sessions judge and ordered him to look into the case and if it was a fake case then police should be charged otherwise the case should be dismissed.
