Court ruling: Judge refuses bail to suspected robber

Judge observed that the robbery was committed by the accused as valuables were found from his possession.

KARACHI:

A district and sessions court dismissed on Wednesday the bail plea of a suspected robber, Allah Dinna, who had injured a man during the robbery bid.

The complainant, Rustam Khan, said that Dinna and his accomplice Misri stabbed and injured him when he put up a fight against their attempted robbery in April this year. On his hue and cry, a crowd gathered and managed to get hold of Dinna while Misri made good his escape, he added.

A case, No. 194/13, under sections 394 (voluntarily causing hurt in committing robbery) and 34 (common intension) of the Pakistan Penal Code was registered against the suspects in Shah Latif Town police station.

After hearing arguments from both sides and perusing over the material on record, the Malir district and sessions judge Muhammad Yamin observed that the robbery was committed by the accused as valuables were found from his possession upon arrest. While denying the bail, the judge also observed that there were reasonable grounds to believe that the accused caused the injury and any leniency in grant of bail will only increase crime and encourage criminals.
