PESHAWAR:
The Peshawar High Court (PHC) on Tuesday served a show-cause notice to former director general (DG) of Excise and Taxation (E&T) Arshad Khan, asking him to appear before the court in person to explain why he demoted an E&T official.
Besides Khan, who is currently serving at the Fata Disaster Management Authority, the court also issued a show-cause notice to former E&T minister Liaquat Ali Shabab, asking him to explain why his name should not be mentioned to the Election Commission of Pakistan for disqualification.
A division bench comprising PHC Chief Justice Dost Muhammad Khan and Justice Musarrat Hilali issued the notices during the hearing of a suo motu case initiated following reports of vehicles being given to influential persons on superdari (temporary possession).
Jandad Khan, an E&T official, had earlier complained he had been demoted to Officer on Special Duty for complying with court orders when he retrieved 81 vehicles from influential persons. Khan asked the court to direct his department to reinstate him to his original position.
The bench directed the E&T secretary to reinstate Jandad Khan. It further maintained superdari vehicles, under NWFP Motor Vehicle Seizure Rules 1999, should be kept at designated warehouses under the provincial government’s custody.
Meanwhile, E&T legal advisor Gohar Rehman Khattak produced an inquiry report which was conducted upon the court’s directives after a former E&T minister’s driver was arrested in a superdari vehicle at Attock.
During the last case hearing on January 23, the court issued auction orders for foreign manufactured supardari vehicles.
