A consumer court on Wednesday issued bail-able arrest warrants for the fourth time for the proprietors of Benazir Kulfa for July 11, in a suit seeking damages of Rs1.05 million from the ice cream maker for allegedly delivering substandard kulfa at a wedding.
The court had already issued notice and bailable arrest warrants on three occasions to the respondents.
Petitioner Haji Ahmed submitted that he ordered 45kg of kulfa, at Rs280 per kg, from the respondents’ shop in Mozang for the wedding of his son. He said that he paid the full amount, Rs12,600, before the ice cream was delivered at the valima ceremony on November 14, 2011.
Ahmed said that the kulfa was delivered two hours late, at 4pm instead of 2pm. Further, it was inedible as soil and sand particles had mixed in with the kulfa. The petitioner said that it was the only sweet dish at the wedding and he had been humiliated in front of his friends and relatives.
He served a legal notice on the respondents on November 18 demanding compensation, but they refused.
The petitioner asked the court to direct respondents Muhammad Ayub, Muhammad Qayyum and Suleman to pay him Rs1 million in damages and Rs50,000 for his lawyer’s fee.
This correspondent made several attempts to contact the respondents, but could not reach them.
