Speaking to the media accompanied by Information Minister Qamar Zaman Kaira, the law minister said that the appeal against the Supreme Court’s decision in the contempt of court case against Gilani can only be filed after the detailed order comes.
“In all similar cases, the court always gives a detailed order, so the accused can read it and file an appeal against it. But the Supreme Court did not give the detailed order in this case, nor did it give the order’s copy to the prime minister.”
He added that the Supreme Court did not disqualify the prime minister and people should not rush in passing judgments. “The trial ends after the appeal is heard… What is the rush all about?”
The speaker of the National Assembly still has 30 days to decide about the prime minister’s fate and till the decision comes, Gilani will continue to be the prime minister of the country and a member of the National Assembly, Naek further said.
Commenting on Pakistan Muslim League (PML-N) chief Nawaz Sharif’s call for Gilani to step down, Naek said he respects Sharif a lot but “he is not getting the right advice”.
Information Minister Kaira said that Prime Minister Yousaf Raza Gilani has always respected the courts and will continue to do so as per the party’s tradition in the future as well.
Kaira said that the Pakistan Peoples Party has always faced its cases in the courts and never tried to break the chain of Justice.
“It was Pakistan Peoples Party which, despite enormous hurdles, strengthened the fractured democracy and Gilani was the man who empowered the parliament like Zulfikar Ali Bhutto and Benazir,” Kaira added.
He also regretted that the PML-N is twisting facts about the court orders.
Privilege motion against SC assistant registrar
The government has decided to move a privilege motion against the assistant registrar of the Supreme Court for writing a letter to speaker of National Assembly to initiate an action against the prime minister under recently passed judgment by the apex court.
Terming the letter ‘illegal’, Law Minister Naek said that the letter in which Speaker of National Assembly Fehmida Mirza was directed to implement the SC’s judgment was an open violation of law. Naek added that the assistant registrar of the Supreme Court is not authorised to issue directions to the speaker of National Assembly.
“We will move a privilege motion against assistant registrar as the letter is illegal which was written as a clear violation of rules and procedures. He has directed the speaker of National Assembly to implement the court’s verdict at the earliest which is we believe is an offence to the parliament.”
Naek went on to say that, “The parliament’s privilege was disparaged by the assistant registrar’s letter to the speaker of National Assembly directing her in the prime minister contempt case.”

SC's verdict created more chaos than before, It looks that the it is under pressure, and just doing face saving measures. We the people are Pakistan are really hopeless of our judiciary, our justice system, Justice Choudhry is no exception.
Can anyone revisit the original issue for which Mr. Gilani was convicted? The court wanted him to write a letter to Swiss authorities about a case which was closed under NRO. Any opinion on the eligibility of NRO beneficiaries occupying Sindh Governor House, Ministers in Federal/Provicial Cabinates, Senators, MNAs and MAPs? And let's not forget The Commondo hiding in London and Lord of Edgware Road Manor either. I am not condoing any party. Let's open all criminal cases against all accused and also open a criminal inquuiry into May 12, 2007 Karachi massacre as well! Don't let Pandora shut her box as yet!
This Law Minister is the second episode of the serial " More Loyal Than the King". The first star Mr. Babar Awan got retired hurt.
These folks have proven that "there is nothing moral in politics"...
They are all for sale...
Why is court not issuing the written order? It takes a few minutes to write such a short order. Why a low official of the SC is proactive and writing to the speaker even before the judges can write their verdict? Yes the PM must step down once there is a written order from the SC deciding his qualifications to be a member of NA. Yes the coalition should elect a new leader of the house/PM as they have majority in the NA and Senate. That should shut the opponents up and the PCO judges would have time to pay attention on the ISI money distribution to all rightwing parties. That case alone would prove that the army and rightwing politicians have always been conspiring against PPP. As far as convicted PM is concerned, he has spent years in jail before, like ZAB, BB, Zardari and many others. Yet the electorate have elected them again and again and the judges who have put them in jail are dead in history.
Govt. believes in their own personalized interpretation of the constitution. Who bothers about the supreme court verdicts.
Are u a fool or the law minister ? You don`t even know how to comply with the court decision.
The fact is that the PM is a tainted person around the world and in any civilized country he would have resigned the same hour when convicted. You know that court's detail verdict will come later and read what the court has given the reason for his conviction, I am sure Mr.law minister that you have a copy of the Pakistani constitution. What is it with you people that despite the fact that Supreme Court's has convicted him according to the constitution but you keep on negating it's decision. Please tell us if a convicted person could be a member of NA or PAs, It is as simple as that.Is there any morality left in him? He is establishing a bad precedence for future generations , the moto for this outfit in Isalamabad is to stay in power regardless of laws.
Do SC need to tell everything? Read between lines, Gillani is disqaulified. SC provided him oppotunity to leave with some honour but he has missed that chance.
EX-PM Gilani is on the same page as the dictators who distorted the constitution in their own favour, except that they threw the entire constitution under the bus, EX-PM Gilani is riding it destroying the bus. Th bus is democracy.
as they are not complying already :-(
Government has no option except to comply with the orders of Supreme Court.
The government should keep it in mind that if it will not comply with the Supreme Court Orders, the Chief Justice of Pakistan can direct the Chief of the Army Staff to get the orders of Supreme Court complied by all means.
In any case, Gilani has to step down, sooner or later, but the sooner will be better for the democarcy and to save the constitution, and in order to save the constitution PM has not written the letter to Swiss Authorities.
'WE DAMN CARE culture has to go. Finding legal excuses to circumvent SC decisions is not good for the people of Pakistan. Mr Gilani should step down temporarily till the appeal is heard anda judgement is made. When the Government itself has no respect for Law, what kind of RULE of LAW people of Pakistan will have. It is time to protect the HONOUR of Pakistan.
All you guys doing is buying PM Gillani more time to pass the upcoming budget ...keep it up! we all know how obedient of constitution you ppl are.
Is Gilani getting the right advice???
Ex- PM Gilani slways proving to be the wrong person at the wrong time doing wrong things..,,
