Newly disclosed video evidence has become the latest point of contention in the ongoing legal dispute between Blake Lively and Justin Baldoni, according to reporting from PEOPLE.

Footage from a deleted It Ends With Us hospital scene—submitted as an exhibit in a Nov. 13 motion for summary judgment—shows Lively and Baldoni filming a brief moment that includes a kiss. Baldoni’s legal team argues the clip demonstrates that Lively, 38, initiated an unscripted kiss during a May 2023 shoot, alleging she “oversaw” the scene and added the kiss despite it not appearing in the script.

The claim directly contradicts Lively’s lawsuit, in which she previously accused Baldoni, 41, of improvising unwanted kisses during production and cited “no more improvising of kissing” as one of the conditions she presented before filming resumed in January 2024.

Lively has sued Baldoni and other Wayfarer representatives for sexual harassment and retaliation—allegations the actor-director has denied. PEOPLE reports that Baldoni’s attorneys had initially argued in a January 2025 filing that all kiss scenes shot before the Hollywood strikes were scripted. They now contend this newly revealed video predates the strike and includes an improvised kiss from Lively.

Baldoni’s separate $400 million lawsuit, which addressed her allegations of unscripted kissing, was previously dismissed by a judge.

Both Lively and Baldoni are expected to testify when the trial begins in March, unless the judge grants the Wayfarer parties’ request for summary judgment. As of now, Judge Lewis J. Liman has not ruled on the motion.

In a Nov. 12 filing, Lively’s legal team claimed they have significant evidence of retaliation, alleging “negative content” about the actress was amplified or manipulated by parties connected to the production. Meanwhile, Baldoni’s attorney Bryan Freedman said earlier this month that they remain committed to “pursuing the truth” in court.
