
Raising concern over the exercise of administrative powers by acting Islamabad High Court Chief Justice Sardar Sarfraz Dogar, the Islamabad High Court Bar Association has requested the Supreme Court to suspend the judges seniority list and restrict its acting chief justice to take all important administrative decisions with the consultation of two senior most judges of the high court.
"It is most respectfully and most humbly prayed that for the abovementioned reasons, this Honourable Court may graciously be pleased to suspend the Impugned Seniority List dated: 03.02.2025 and direct that major administrative decisions (including but not limited to constitution of benches and fixation of cases) regarding the Islamabad High Court (IHC), should be taken by the Acting Chief Justice/Respondent No 13 only after substantive consultation with two next senior most judges of the IHC, during the pendency of the present Petition," says the application filed by Islamabad High Court Bar Association through Faisal Siddiqi advocate.
A five-judge Constitutional Bench led by Justice Muhammad Ali Mazahar is taking up the petitions filed by IHC five judges as well as the Islamabad High Court Bar against the seniority of judges determined by former IHC CJ Aamer Farooq.
The application states that the exercise of powers by the Acting Chief Justice (ACJ), along with the administrative powers delegated by the outgoing Chief Justice of the IHC to the judges who have since been transferred, raises significant legal concerns particularly given that the legality of the transfers themselves is under judicial scrutiny.
