Harvey Weinstein retrial: Prosecutors considers new indictment as more accusers come forward

New accusers have come forward with sexual assault allegations against Harvey Weinstein.

Manhattan prosecutors are considering filing a new indictment against Harvey Weinstein as they evaluate additional claims of sexual misconduct made against the disgraced film producer. Assistant District Attorney Nicole Blumberg revealed during a court hearing that more individuals have come forward with allegations, and prosecutors are assessing which fall within the statute of limitations.

Some potential survivors who were hesitant to testify during Weinstein's first New York trial may now be willing to participate. While Weinstein's lawyer, Arthur Aidala, expressed confidence that no new accusers would strengthen the prosecution's case, Judge Curtis Farber acknowledged the possibility of a new indictment and set the next hearing for July 9.

During the hearing, Judge Farber also addressed a request from prosecutors to remind Weinstein's lawyers not to publicly disparage potential witnesses. The district attorney's office argued that Aidala's recent statements aimed to intimidate Miriam Haley, a former production assistant Weinstein was previously convicted of sexually assaulting. Aidala apologized but maintained his client's right to a "vigorous defense."

Haley's lawyer, Gloria Allred, called for Aidala to apologize for his "unwarranted, vicious and false" attack on her client. However, Aidala declined. Haley has yet to decide whether she will testify in the retrial.

Weinstein, appearing in a wheelchair due to ongoing medical issues, attended the hearing in the same courthouse where former President Donald Trump is on trial. He is currently incarcerated at Rikers Island jail complex.

In 2020, Weinstein was convicted of rape and sexual assault but the convictions were overturned last month due to procedural errors. The retrial on the rape charge is tentatively scheduled for after Labor Day.

The new allegations against Weinstein reopen a painful chapter in the #MeToo movement, which gained momentum in 2017 following numerous accusations against the former film producer. Weinstein is also serving a 16-year sentence in California for another rape conviction.
