Petitioner says case lodged on his deceased sister's behalf to occupy property

Lahore High Court heard a case regarding the registration of an FIR by Sailkot police with a woman who had died 16 years ago as the complainant.

Justice Malik Shahzad Ahmad Khan asked how it was possible that Fehmida Arshad who had died in 2005 was the complainant in the case of theft registered by in 2021.

The judge sought reply from Sialkot police on a petition for quashing the FIR. The petitioners alleged that the case had been registered in connivance with police officials.

On a court query, the petitioner’s counsel presented the death certificate of the complainant.

Petitioner Muhammad Akbar who is nominated as accused in the FIR, contended in his petition that he the had been implicated in a false FIR whose complainant had died 16 years before its registration.

The petitioner’s counsel stated that the accused Akbar was brother of the complainant. His relative Arshad had got registered the FIR against him to occupy his property, the counsel contented.

He said Motra police had registered the FIR.

The counsel told the court that the petitioner had obtained pre-arrest bail from the district court and had now approached the LHC for quashing the FIR registered on December 31, 2021.

The FIR states that the complainant was beaten up by accused Akbar who along with his henchmen destroyed her wheat and took away fertiliser bags.
