A division bench of SHC issues notices

KARACHI: A division bench of SHC, comprising of Justices Muhammad Ali Mazhar and Agha Faisal, issued notices to four members of the Election Commission of Pakistan (ECP), asking them to explain under what authority they hold their offices. The petition was filed by the Aam Log Ittehad party Secretary General Azhar Jameel and a member of the party, Justice (retd) Wajihuddin Ahmed. The petition seeks an order in the nature of a writ of Quo Warranto under Article 199 of the Constitution of Pakistan. The petition said that the members, who had served as judges, were appointed in violation of Article 207(2), which says that “a person who held office as judge shall not hold any office of profit in the Service of Pakistan not being a judicial or quasi-judicial office.”
