K-P health department takes up first case from FATA following merger

PESHAWAR: The Khyber-Pakhtunkhwa (K-P) health department on Wednesday took up the first ever case from the Federally Administered Tribal Areas (Fata), which is now part of the province following the merger.

A lady health worker from district Mohmand was posted at the disposal of district health officer Peshawar.

"In exercise of the jurisdiction granted by the 31st Constitutional amendment over the service matter of employees of erstwhile Fata who are now employees of the provincial government with the same status, the application of Farhana Yasmeen is accepted and she is posted at disposal of the district health officer Peshawar," read a notification issued by K-P's health department secretariat.

Farhana Yasmeen, a resident of the provincial capital, was employed on contractual basis before she started serving in the tribal areas.

FATA interim regulations challenged in PHC

However, she filed a petition at Peshawar High Court (PHC) under Article 199 of the Constitution seeking her transfer after serving in the tribal areas for 13 years.

Yasmeen's appointment letter stated that she was appointed by the director health services for tribal areas and could not be transferred.

As per the K-P government's policy prior to the merger, all those appointed in the appointment in settled areas must resign before being appointed in settled areas and resume service as a fresh candidate.

However, the 31st Constitutional amendment passed by the parliament abolished separate status of Fata after it was merged with K-P.
