Indian father gets 20 years jail for raping minor daughters

The elder 16-year-old daughter told Chandigarh Police that her father had been sexually assaulting her for a long time

A 45-year-old man was jailed for 20 years for raping his two minor girls, eight months after the girls complained of the sexual assault to a doctor who called the Child Helpline, reported the Hindustan Times.

The man’s elder 16-year-old daughter told Chandigarh Police that her father had been sexually assaulting her for a long time, forcing her to live with her uncle on the first floor of the same house. But, her seven-year-old sister and four-year-old brother continued to live with their father on the ground floor. Their mother had passed away.

Her younger seven-year-old sister then told her that she was being sexually abused by their father. The elder sister approached a local doctor, who called the Child Helpline.

The victims then narrated the entire story to the helpline counselors. Police were informed and based on the girl’s statement and a medical examination confirming rape, the father was arrested.

Chandigarh Police registered a case under Sections 354 (assault or criminal force to woman with intent to outrage her modesty), 354A (sexual harassment), 376 (2) (f) (commits rape on a woman when she is under 12 years of age) of the Indian Penal Code, and Section 10 (aggravated sexual assault) of the Protection of Children from Sexual Offences (POSCO) Act.

On Friday, the accused was held guilty under Section 6 (aggravated penetrative sexual assault) of the POCSO Act, and sentenced to 20 years in prison.

The local court of additional district and sessions judge Poonam Joshi also ordered a fine of 2.05 lakh INR to be paid of which 1 lakh INR will go to each sister.
