One-month bar: PHC restrains Rs600m sales tax recovery
The court issued notice to FBR on a petition filed by Pesco
PESHAWAR:
The Peshawar High Court on Tuesday restrained Federal Board of Revenue from recovering Rs600 million from Peshawar Electric Supply Company (Pesco) under the head of sales tax.
The court also directed Commissioner Inland Revenue to decide the appeal within a month.
The court issued notice to FBR on a petition filed by Pesco through its attorney Shamail Ahmad Butt.
Arguing before a division bench, headed by PHC Chief Justice Yahya Afridi, Butt said that FBR issued a notice to Pesco for depositing the amount, contending that Pesco has failed to recover Rs600 million under sales tax in utility bills.
He argued that FBR has taken the stance that Pesco would pay the amount from its own coffers against which the latter filed an appeal. He prayed the bench to restrain FBR from recovery of the amount which was accepted with direction to the commissioner to decide it within a month.
