Ehtesab DG appointed 11 months before EC notified: Shabab
Former minister filed petition with PHC, asked for Hamid Khan’s arrest

Former minister for excise and taxation Liaquat Shabab has challenged the appointment of the director general of Ehtesab Commission at Peshawar High Court. Shabab filed the petition through his attorney Qazi Jawad Ehsanullah on Friday.
According to the petitioner, the appointment of Lieutenant General (retd) Muhammad Hamid Khan to the office of DG was made in violation of mandatory provisions of K-P Ehtesab Commission Act, 2014. Records show the notification for establishing the commission was issued by the K-P government after appointing the DG. Without the existence of the commission, the very appointment which is being challenged is nullified in the eyes of law.
The petitioner also questioned the actions taken by the DG, starting from the issuance of a notice and culminating in his arrest, freezing of properties and all such acts. The petition stated the appointment of Hamid Khan, having taken place when the commission was not even in existence, is void ab initio and without jurisdiction. It further stated all executive orders, functions, notifications and actions issued or taken place under DG’s command should be dismissed since the basic appointment has taken place in absolute violation and disregard of the mandatory provisions of the act.
In addition, Shabab asked the court to issue an arrest warrant for the DG and declare his appointment illegal. He urged the court to issue a declaration of invalidity in regard to his arrest and grant relief that is considered appropriate given the circumstances.
