Petitioner prays court to declare the arbitrary appointments illegal
ISLAMABAD:
The Islamabad High Court on Thursday issued notices to secretary human resource development and six members of the National Industrial Relations Commission (NIRC) in a case challenging the appointment of the members.
Justice Noorul Haq N Qureshi issued a notice on the petition of advocate MA Ghani. Ghani has challenged the appointment of the NIRC members, claiming it to be a violation of the constitution.
In the petition, Ghani stated that the appointment of the NIRC members under section 53 of Industrial Relations Act (IRA) 2012 by the government was arbitrary and without meaningful consultation with the chief justice of Pakistan.
Apart from the secretary human resource development, the petitioner made six members – Baqir Ali Rana, Ghulam Nabi Drashak, Syed Maroof Ahmed Ali, Qamaruddin Bohra, Muhammad Akbar Sani and Azharul Habib respondents in the matter.
The petitioner, being a lawyer, stated that he is an aggrieved party.
Ghani prayed the court to declare section 53 of the IRA 2012, which gives arbitrary power to the government to appoint NIRC members, illegal and in violation of the constitution.
