Non-maintainable: Petition against judicial commissions dismissed

LAHORE:

Justice Ijazul Ahsan of Lahore High Court (LHC) remarked on Tuesday that constitution of a judicial commission was the discretionary power of a chief justice.

He made the observation while dismissing a petition challenging the formation of commissions at the government’s request. The judge ruled that the petition was not maintainable.

Advocate Muhyuddin had filed the petition submitting that several commissions had been formed in the past but their recommendations were not taken seriously.

“What is the use of forming a commission when its recommendations are not implemented?” He said that instead of implementing the recommendations of a judicial commission that had probed last year’s riots in Model Town the government had tasked a joint investigation team with investigating the violence.

Separately, the LHC restrained a trial court from holding proceedings against former Election Commission secretary Afzal Khan until September 9. Riaz Kayani, a commission member, had filed a petition against Khan.

Khan had said that a sessions court could not proceed against him.
