A division bench, comprising justices Naimatullah Phulpoto and Muhammad Iqbal Kalhoro, observed that the main petition is already fixed for hearing on May 14.
Sadia Bano, wife of Khan, had moved a miscellaneous application on Wednesday against his transfer outside the city. She came to know through media reports that her husband is being transferred outside the jurisdictions of the high court where her petition against his detention is already pending decision. She pleaded the court direct the provincial authorities not to shift the custody of Moazzam outside the jurisdictions of the SHC.
Through another miscellaneous application, Bano had also sought a direction for the relevant authorities to shift Khan to some private hospital for treatment. She claimed that her husband needed immediate medical assistance.
Rangers had obtained orders from the anti-terrorism court to detained Khan for 90 days on allegations of facilitating two Karachi men, who had allegedly killed MQM’s Dr Farooq in London.
Meanwhile, Bano had filed a petition with the high court alleging the Rangers authorities of taking Khan into custody from his Azizabad residence and keeping in illegal detention since April 12.
