Seeking accountability: Candidates go to PHC over illegal appointments at teaching hospital

Petition says 27 candidates appointed in violation of APT rules.

Candidates who had applied for various positions in Khyber Teaching Hospital (KTH) have accused the government of appointing unqualified personnel and flouting rules. They went to the Peshawar High Court (PHC) against the government’s decision and requested the court to declare the appointments illegal.


The petition was filed by seven candidates—Zahid Khan, Muhammad Noman, Shoaib Ahmad, Asfaq, Nishat Ahmad, Hashim Gul Khalil and Burhanuddin—who had applied for the posts of ward orderly, guard and janitorial staff. KTH chief executive, medical superintendent (MS), director finance and budget officer as well as 27 recently-appointed candidates have been named as respondents. In addition, the health secretary, personal assistant to the health minister and Khyber-Pakhtunkhwa (K-P) accountant general have also been listed as respondents.

According to the petition, 27 candidates have been appointed in violation of appointment, promotion and transfer (APT) rules. Furthermore, the appointments have been made without lawful authority, advertisement and in violation of rules for the appointments of BPS 1 to 5.




It stated that after applying, the petitioners came to know the hospital CEO, MS, director finance and health secretary made appointments of some of 136 persons in BPS 1-3. Out of these, 49 employees were illegally appointed, according to the petitioners.

“Muhammad Nouman who has a BSc honours in agriculture was not even called for an interview for the post of ward orderly,” said the petition. On the contrary, the KTH appointed “blue-eyed persons” from other districts, it added.

According to the petition, the petitioners were qualified for the posts and had approached the competent authority. However, they were told the appointment committee has already made the requisite appointments.

“All the appointments are politically-motivated and only serve to please the health minister,” the petition says.

A bench comprising Justice Qaiser Rashid and Justice Asadullah Khan Chamkani issued notices to KTH CEO and MS to submit written replies in the case.
