Not maintainable: Intra-court appeal for disqualifying PM dismissed
The bench, headed by Justice Ijazul Ahsan, took up the petition and observed that the appeal was not maintainable.
LAHORE:
A Lahore High Court division bench on Monday dismissed an intra-court appeal against dismissal of a writ petition seeking disqualification of Prime Minster Nawaz Sharif and Interior Minister Chaudhry Nisar Ali Khan for allegedly lying to the parliament about army’s role in the prevailing political impasse in the country.
The bench, headed by Justice Ijazul Ahsan, took up the petition and observed that the appeal was not maintainable. The bench upheld the decision of the single bench and dismissed it. Insaf Lawyers’ Forum-Punjab senior vice president Advocate Gohar Nawaz Sindhu had filed the appeal. The petitioner said the prime minister and the interior minister had violated the Constitution in lying to parliament when they had stated that the government had not invited the chief of army staff (COAS) to mediate in the deadlock with Pakistan Awami Tehreek and Pakistan Tehreek-i-Insaf (PTI).
He stated that the ISPR had refuted government’s version.
He said the government had given the impression that the chief of army staff had intervened at the request of the PTI and PAT leaders.
The lawyer said Article 63 of the Constitution envisages disqualification of a member of parliament for defaming or ridiculing army.
He said the prime minister should be disqualified under Article 63 of the Constitution.
