KARACHI:

The Supreme Court (SC) issued notice to the provincial prosecutor-general and the investigation officer to submit a progress report in the case relating to the murder of the son of a district and sessions judge. The victim was allegedly killed at the behest of another judge.

A three-member bench, headed by Justice Anwar Zaheer Jamali, passed these directions while hearing an application seeking the release of Sikandar Ali Lashari, the district and sessions judge in Mithi, who is currently facing the murder trial.

Aqib Shahani, the son of the district and sessions judge in Jacobabad, Khalid Hussain Shahani, was shot dead by unknown assailants in Hyderabad on February 19.

Later, the victim's cousin, Hunain Hussain, had registered an FIR No. 12/2014, implicating that Aqib was killed at the behest of Lashari.

On Wednesday, the under-trial judge filed a bail application. His lawyer, ZK Jatoi, submitted that the police had failed to make any progress in the investigation during the last 65 days of remand.

Rather, he alleged, that the police were making false criminal cases against the applicant. The lawyer claimed it was a simple murder case, but the police have added Section 7 of the Anti-Terrorism Act 1997, which was against the laws and fundamental rights of the applicant.

The court was pleaded to grant post-arrest bail to the applicant and order his release because there was no apprehension of his escape.
