KARACHI:

A district and sessions court added premeditated murder charges after over-ruling a charge sheet submitted by the police, against a paramilitary soldier who allegedly killed a man near Nagan Chowrangi.

Zeeshanuddin, 30, was shot dead when he was engaged in a brawl with his estranged wife near Nagan Chowrangi on February 28.

A judicial magistrate in district Central, Fida Hussain Abbasi, dismissed the investigation officer’s (IO) findings that the murder was unintentional and issued non-bailable warrants against the victim’s wife, Shafia, whom the police had decided not to send up for trial in the case.

“I do not agree with the IO’s report and take the cognisance of this case under Section 302 of the Pakistan Penal Code against the nominated accused in compliance of Section 190 (1) of the Criminal Procedure Code,” the judge stated in the order. The judge added that he had given full consideration to the facts of the case, the evidence collected by the IO and adduced by the complainant. “It has been observed that the IO has not conducted the investigation according to the law.”

The judge found that Shafia had been nominated in the FIR by the complainant but the IO did not investigate the allegations levelled against her. He added that the IO did not give due attention to the overall investigation and simply submitted a summary report. It was also observed in the order that the victim had two bullet wounds. Judge Abbasi stated that there was sufficient evidence to corroborate the contention of the complainant and witnesses who had implicated the suspect, Shafia, for playing a role in her husband’s murder.
