LDA Jurisdiction: Notices issued on legal challenge
The court has already suspended operation of two notifications issued by the Punjab government in this regard.
LAHORE:
Lahore High Court on Thursday issued fresh notices to the federal and provincial governments on a petition challenging extension of jurisdiction of the Lahore Development Authority to Sheikhupura, Kasur and Nankana Sahib. The court has already suspended operation of two notifications issued by the Punjab government in this regard. National Bank of Pakistan Officers Cooperative Housing Society had approached the court against the LDA control of private housing schemes. The petitioner-society, through its counsel, said the government amended Section 13 of LDA Act 1975 and empowered it to govern all private schemes. The counsel said the amendment required town municipal officers to transfer all pending or approved cases of land and private housing schemes to the LDA. The counsel said under the LDA Act, an approved scheme could not be transferred. He said the NBP housing scheme was established for officers of the bank. He said only a formal approval of the scheme was needed from the Nishtar Town TMO. The counsel prayed to the court to set aside the notifications and restrain the TMO from transferring the NBP Housing scheme to the LDA.
