KARACHI:

A district and sessions court directed on Monday the New Karachi station house officer of police to register a case against the Rangers official and the estranged wife of the deceased, Zeeshan, if a cognisable offence was made out from the petitioner’s statement.

Zeeshan, 30, was shot dead on Friday when he was engaged in a brawl with his estranged wife near Nagan Chowrangi.

The court was hearing the application, filed under section 22-A of the Criminal Procedure Code, by the victim’s sister, Tasneem Shahid. Allowing the application, Javed Akhtar Awan, an additional district and sessions judge in district Central, ordered to register the case against the Rangers official and the deceased’s wife, Shafia.

The counsel for the victim’s family, Amir Warraich, said that they had approached the court as the police had refused to register the case. He added that the FIR which was earlier registered at the police station on behalf of the victim’s wife, Shafia, was false and fabricated.

Warraich said that the facts were distorted in the FIR registered earlier, adding that the demand of a separate case arose because Shafia was not at ‘good terms’ with her husband and his family.

“We want to nominate both the Rangers personnel and Shafia in the FIR as the Rangers’ man opened fire on Zeeshan after Shafia asked him to do so,” Zeeshan’s sister told The Express Tribune. Shahid claimed that it was pre-planned murder and her brother was beaten with a ‘bat’ before being shot dead. “My brother’s forehead was ripped apart and there were torture marks on his hand as well.”

Shahid said that she would go to the police station to register the case after her brother’s Soyem.  “It was our demand since the incident took place.”

The previous FIR was rejected by the victim’s family who also protested the incident along with hundreds of other people outside the New Karachi police station and near Nagan Chowrangi.

Meanwhile, New Karachi DSP Fayyaz said that there was room for a counter FIR but it could only be determined whether an FIR should be registered once the victim’s family came forward to record their statement before the police.
