SHC orders probe into torture allegations

The Sindh High Court (SHC) ordered the government on Tuesday to constitute a medical board to investigate the allegations of torture on the Muttahida Qaumi Movement activist during police custody.


SHC Chief Justice Maqbool Baqar, who headed the bench, ordered the provincial health secretary to constitute a medical board for conducting a thorough and intensive medical examination of Fahad Aziz. The secretary was given 15 days to submit a detailed and comprehensive report along with relevant material regarding the suspect’s state of health and injuries that he may have suffered from alleged police torture.

Earlier, the additional advocate general Muhammad Sarwar Khan filed comments of East zone’s senior superintendent police, who informed that the Shah Faisal police had arrested Fahad with his driver under Section 54 of the Pakistan Penal Code on February 8 over his involvement in heinous crimes, including recent target killings of four policemen.


During interrogation, Fahad confessed to killing the Ibrahim Hyderi police officials, claimed the SSP, adding that during the interrogation, Fahad complained of deteriorating health and was immediately shifted to a private hospital from where his arrest was deferred because he was under treatment. Subsequently, he was released on personal bond and surety of MNA Iqbal Muhammad Ali while his driver Muhammad Rehan was released on personal bond and surety of MPA Irtiza Farooqui.

The officer informed that the Sindh police IG has nominated DIG East as the inquiry officer to probe into the arrest and alleged maltreatment by the interrogation team.

Deputy attorney general Aslam Butt requested for time to file comments of the interior ministry while Major Ashfaq Ahmed also sought time to file replies of DG Rangers.

AAG Sarwar Khan and DAG Butt along with nother police officers maintained that the provincial and federal forces have neither acted nor indulged in any illegality nor shall they do so in future.

The bench directed the federal and provincial authorities to conduct themselves in accordance with law and not indulge in any illegal or unlawful act, giving any cause of complaint to the petitioners or anybody else. The judges also directed SHO Shah Faisal police to file a copy of the Roznamcha (daily dairy) pertaining to arrest of Fahad Aziz, who was allegedly arrested while firing on police personnel by today (Wednesday).
