Family feud: Mother takes lower court judge, official to SHC

Tired of a year-long wait at a subordinate court, Shaheena has gone to the Sindh High Court against a sitting judge and a ‘non-receptive’ court official, against their alleged corrupt practices.

Shaheena has been engaged in a legal battle with her former husband, Javed Haider, in a guardian and ward case at a subordinate court for over a year now. She claims that it was because of the lower court judge and the court official that she had not been able to meet her three daughters for the last few weeks.

She went to the SHC against a civil and family judge in district East, Abdul Qadeer Buriro, saying that he didn’t take any action against her former husband when he didn’t comply with the court’s order to bring their children for a meeting with her for two hours every Saturday.



While taking a firm stand against the corruption of court officials in terms of ‘mithai’ or ‘chai-pani’, she alleged that the court official treated her harshly and refused to answer her queries when she did not offer him bribe.

She alleged that the court official would fix the next date of hearing for the case as per her former husband’s wishes, adding that it’s been over a month since she had seen her daughters.

“The judge has not been impartial and the official treats me very harshly because I did not offer him bribe,” she stated in the application. She filed a similar application before the district and sessions judge in district East.


Following her application, the district judge of East directed judge Buriro to take immediate action and solve her complaint. Unfortunately, the file containing the directions remained at district judge’s court for two days and was moved to the relevant court only after her lawyer urged the officials.

After the file reached the court, judge Buriro issued notice to her former husband directing him to appear before the court at the next hearing with his children. The court also warned him that strict action would be taken in case of his absence. Sources confirmed that the court bailiff has served the notice.

“This is absolutely untrue. All allegations are absolutely false and fabricated,” claimed Haider, adding that he had never given a penny to the court official to obtain any favours.

Haider said that his former wife missed the last meeting because she had to attend her office, adding that he had reminded her lawyer about the meeting through a text message.

Haider said that he has no objection over the children meeting with their mother but for that Shaheena should be available at a fixed date and time at the designated place. “I can’t send my daughters to her home because her brother is a drug addict and I want to keep my daughters away from him.”

Shaheena and Haider got married in 2004 and but were then divorced in December 2012. The court has fixed February 15 as the next date of hearing.
