An 'honest plea': SHC wants Hamza murder case to be reinvestigated

Deceased’s father alleges investigation officer of covered up for the accused.

KARACHI: The Sindh High Court (SHC) ordered DIG AD Khawaja on Tuesday to re-investigate the Hamza Ahmed murder case and submit a report to the Anti-Terrorism Court (ATC) within a month.

The bench headed by Justice Ghulam Sarwar Korai was hearing a petition filed by the deceased’s family, seeking the reinvestigation of the murder through “impartial” officers.

Hamza, a 17-year-old student of O’ Levels, was allegedly gunned down by the security guard of another teenager, Shoaib, after an altercation between the two outside a restaurant in the Defence Housing Authority on April 27.



Hamza’s father, Talib Suhail, had registered a murder case under Sections 302 (premeditated murder), 114 (abettor present when offence is committed) and 34 (common intention) of the Pakistan Penal Code, naming Shoaib Naveed, his father Naveed Ahmed, their guard Amal Rehman and others as accused.

In August, Talib approached the high court to direct the police chief to order re-investigation of his son’s murder case by a team of ‘honest’ police officers. He alleged that the police official investigating the case had concealed crucial circumstantial evidence, which was enough to establish Shoaib’s involvement in the murder, from the court.

In his plea, he claimed that the officer had obtained two compact disks containing video footage of the incident captured by the close-circuit cameras in DHA, but he did not produce it as evidence in court.

He also alleged that the investigation team threatened the independent eyewitnesses who have disappeared.

“From the photograph taken during the postmortem, it is clear that in addition to the bullet marks on the chest, there is clear and visible mark of sharp edge weapon on the left side of the face of the deceased,” he argued, accusing the police of deliberately trying to distort the evidence to benefit the accused party.

The court was asked to order the IG to constitute an inquiry committee, comprising honest officers, for investigation of the case.

Mehmood Alam Rizvi, who appeared for Shoaib Naveed, had previously claimed that the police had investigated the matter honestly but found nothing against his client.

On Tuesday, the bench ordered DIG AD Khawaja to supervise reinvestigation into the case and submit the report within 30 days at ATC III where the case is pending.

I feel sorry for the parents. They not only lost their son but are being denied justice continuously. Death of justice in our society is condemnable.
