Unfair means: Misbahuddin’s promotion declared illegal

Sindh High Court declared on Thursday the promotion of Misbahuddin Farid, the managing director of the Karachi Water and Sewerage Board, as illegal.


The bench, headed by Justice Faisal Arab, passed this ruling on a petition accusing Farid of having promoted himself from grade-19 to grade-20 in violation of services rules. Qutbuddin Sheikh, a KWSB  chief engineer, had gone to the court this July saying the KWSB chief promoted himself by influencing the departmental promotion committee.

His lawyer, Nawaz Sheikh, stated Farid had presided over the committee meeting on October 8, 2012, and promoted himself illegally. Later, a notification regarding his promotion was issued by the relevant authority.


In order to hush up the process, the lawyer alleged, minutes of the said meeting were also removed on the directives of Farid.

The court was pleaded to declare the promotion of the KWSB managing director as illegal. The petitioner also requested the court to direct the relevant authorities to reconsider his name for promotion.

After preliminary hearing, the SHC bench issued notice to the provincial chief secretary, the KWSB chief and others to submit their comments, which were filed later.

On Thursday, the SHC bench declared that promotion of the respondent illegal.

SHC directed the government to appoint an officer of 20 grade on the post of the KWSB MD on a ‘permanent’ basis. It also directed that a new departmental promotion committee should be constituted to consider the names of the officers for promotion.
