Election candidates: PHC dismisses petitions filed against tribunal verdicts
Applications were filed against candidates from PK-73 and PK-74.
PESHAWAR:
The Peshawar High Court (PHC) on Thursday dismissed two separate applications filed against the election tribunal’s decisions.
The applications were filed against Malik Naqeebullah and Anwar Hayat Khan, whose nomination papers were accepted from PK-73 Bannu and PK-74 Lakki Marwat, respectively.
While hearing the applications filed against the two candidates, a PHC bench comprising Justice Nisar Hussain, Justice Malik Manzoor Hussain, Justice Syed Afsar Shah and Justice Ikramullah Khan turned down the requests to seek their disqualification from the upcoming polls.
Petitioner Niaz Muhammad’s counsel informed the bench Naqeebullah had been charged by a court to pay a fine of Rs5,000. The counsel added Naqeebullah was also involved in other cases and requested the court to disqualify him on these grounds.
However, Naqeebullah’s counsel informed the bench the court verdict against his client had later been set aside by the Bannu High Court, upon which the bench dismissed Muhammad’s application.
The petition against Hayat was filed by a voter, whose counsel claimed the PK-74 candidate had concealed facts while declaring his assets.
He alleged Hayat had also concealed facts regarding his income tax returns, terming these transgressions in violation of the 1976 Representation of People Act. The counsel requested Hayat’s disqualification as a consequence.
However, Hayat Khan’s counsel, Qazi Jawad, successfully argued his client had not concealed the mentioned facts, and the bench upheld the election tribunal’s original decision.
