The Anti-Corruption Establishment (ACE) informed the Peshawar High Court (PHC) on Tuesday that encroachers have reoccupied retrieved graveyard land in the province’s Mansehra and Bannu districts.


The ACE further informed a PHC division bench comprising Chief Justice (CJ) Dost Muhammad Khan and Justice Musarrat Hilali that authorities were yet to issue any notice to those who had encroached on land given to graveyards in DI Khan.


The bench observed no one was allowed to occupy the land as it had been gifted to graveyards, and asked concerned officials to retrieve it from those responsible for the encroachment.

The deputy commissioners of Peshawar, Malakand and Mardan divisions, submitted a report on the issue along with revenue records.

Auqaf officials told the bench they had sent a summary to the finance department regarding protection measures for the land such as hiring guards and constructing a boundary wall. The officials said the summary had been refused.

The bench directed Auqaf officials to resend the summary with reasonable demands and also asked the finance department to look into the matter in the name of public interest as the land under threat had been purchased on the expense of the public exchequer.
