Consumer rights: Commission appointed to report on product quality

Petitioner says marble shop delivered poor tiles of the wrong colour.

A consumer court on Monday deputed a commission to visit the house of a petitioner seeking Rs368,000 damages from a marble shop for delivering him substandard tiles.

The respondent told the court that the tiles delivered to the petitioner were not substandard. He said their colour was the same as selected by the petitioner. The court then deputed the commission and directed it to submit a report by March 5.

Petitioner Syed Nazim Ali Shah said that on March 5, 2012, he purchased black silky marble tiles from the Nawazish Marbles for Rs68,000.

He paid Rs50,000 in advance. The remaining amount was to be paid after the delivery of tiles.

He said he hired the labour to fix the tiles but when the tiles were delivered, it transpired that they were substandard and of a different colour. He said he went to the respondent with complaint but he did not listen to him.

He prayed to the court to direct the respondent to return his Rs68,000 and also pay him Rs50,000 for labour cost, Rs50,000 for construction material that went waste and Rs200,000 damages.
