Manufacturer to pay Rs10,000 for selling faulty rickshaw

Judge tells Stalcho Motors to also replace faulty gearbox in rickshaw.

A consumer court on Saturday directed a rickshaw manufacturer to replace the gear box and pay Rs10,000 to a petitioner for selling him a faulty rickshaw. The petitioner was seeking Rs450,000.


Petitioner Ali Hussain said that on March 2010, he purchased a Stalcho Commando rickshaw from the Stalcho Motors (Pvt) LTD for Rs150,000 with a warranty for three months. He said there was a fault in the gear box. He said he approached the company’s service centre at Chauburji but the problem persisted.


He prayed to the court to direct the respondent to replace the rickshaw or return its price besides paying damages. He said the respondent be directed to refund Rs150,000 he had paid for the rickshaw price, Rs165,000 for mental agony and Rs90,000 for loss of business.

Abdullah Qureshi appeared before the court on behalf of the respondent and said the petitioner had visited them one day before the expiry of warranty. His auto was properly checked and he was told that the gear box would be replaced two days later but he did not turn up.

The judge said the petitioner was entitled to replacement of the gear box and directed the respondent to pay him Rs10,000 for loss of business.
