Warrants issued over hearing no-show

The complainant’s counsel questioned why the judge had been unable to get his orders implemented.

LAHORE:

Additional District and Sessions Judge Rai Muhammad Ayub Khan Marth issued non-bailable arrest warrants for a Crimes Investigation Agency (CIA) investigation officer (IO) after he failed to turn up for a murder case hearing on Tuesday.

The judge also issued a show cause notice to the CIA deputy superintendent of police (DSP) and directed the capital city police officer (CCPO) to hold both officials’ salaries and initiate departmental proceeding against them.

The absence of Cantonment CIA IO Tariq Sajwar for a fifth consecutive hearing provoked an angry outburst from Advocate Pir SA Rasheed, the complainant’s counsel, who questioned why the judge had been unable to get his orders implemented.

The advocate said that this was the fifth time that the judge had issued a notice to the IO to testify regarding the investigation of the double murder case, but he had not turned up.

“Does your order hold no worth for police officials?” witnesses quoted the lawyer as saying, among other sarcastic comments. Other lawyers in the court were able to calm the advocate.

Marth, speaking to The Express Tribune, said that the lawyer’s outburst was regrettable. He said that there were some scheduled hearings of the case at which the IO had turned up while Rasheed had not because he had been busy with other cases.

Rasheed is representing Inamullah, whose brother Saifullah and father Muhammad Nazir were murdered. He told The Tribune that he believed that the investigation officer was deliberately avoiding case hearings because he was a friend of a friend of one of the accused, Hafiz Irshad. He said that the officer had conducted a biased investigation.
