Notices issued in kidnapping case

The Sindh High Court (SHC) issued notices to the Sindh home secretary, Sindh police chief and SIU chief.

The Sindh High Court (SHC) issued notices to the Sindh home secretary, Sindh police chief, Special Investigation Unit (SIU) chief and subordinate officials on Wednesday over the alleged kidnapping of a businessman by police and forcing him to sign cheques.

A division bench comprising Justice Amir Hani Muslim and Justice Syed Hasan Azhar Rizvi also summoned SIU Inspector Kiyani and Sub-Inspector Fayyaz Malik on September 23.

Petitioner Abdul Ghani impleaded the home secretary, IGP Sindh, SSP SIU Raja Umer Khattab, Inspector Kiyani, SI Fayyaz Malik, Dr Masood Malik and Kokab Farooqui as respondents. His counsel submitted that the petitioner had business relations with Farooqui, who made a proposal to him to invest in his business of seafood products. Later, they developed differences.


In April 2010, SIU Inspector Kiyani and SI Fayyaz Malik on the instigation of the respondent Dr Masood Malik kidnapped the petitioner when he was returning home from the fisheries. SIU officials allegedly kept him in unlawful detention, subjected him to torture and obtained signatures on cheques in favour of Masood Malik and Kokab Farooqui. Later, he was set free. The counsel prayed to declare the detention of the petitioner by SIU officials illegal and order the IGP Sindh to take action against them.

SHC division bench issued notices and directed the petitioner to address letters to banks, restraining them from cashing the cheques.
