Domestic violence: Man accused of disrobing sister-in-law sent to jail
Court cancels his pre-arrest bail, revises FIR under section 354-A.
HARIPUR:
A man who allegedly beat up and disrobed his elder brother’s wife was sent to jail by the court of an additional session judge on Monday.
Additional Session Judge Nasrullah Khan Gandapur cancelled the pre-arrest bail of the accused, Naveed (son of Muhammad Yaqub), and sent him to Haripur jail on judicial remand.
According to Advocate Raja Yasir Ayaz Kiyani, Naveed had an argument with his client, Fauzia Taimoor, 23, at her residence. During the altercation, he beat her up, dragged her out on the alley and disrobed her. He fled when the neighbours intervened.
Kiyani, who is a renowned human rights lawyer, said that when his client approached the police to register a First Information Report (FIR), the official in-charge, Haroon Khan, allegedly delayed registration of the report. Later, he booked the suspect under the more lenient section 354 of the Pakistan Penal Code (PPC).
Kiyani said that under the circumstances, the police should have booked the suspect under section 354-A of the PPC, adding that booking him under section 354 was a “technical favour” given to him by the police.
Kiyani, along with his colleagues Advocate Saadia Raja and Advocate Ghulam Muhammad Awan moved the court of the additional sessions. On the directions of the judge, police revised the FIR under section 22-A of the PPC and charged the accused under section 354-A.
According to section 354-A: “Whoever assaults or uses criminal force against any woman, and strips her of her clothes, and in that condition, exposes her to public view, shall be punished with death or with imprisonment for life, and shall also be liable to fine”.
