Notification stopping judge from performing duties suspended

Retired D&SJ wants to be allowed to complete his term at accountability court.

The Lahore High Court on Thursday suspended the federal government’s notification restraining an accountability court judge from performing his duties and sought a reply from the federation within two weeks.

Justice Ijaz Ahmad issued the order while admitting the petition filed by judge, Mian Muhammad Shafi. Shafi has challenged his removal.

Petitioner’s counsel Raja Abdur Rehman submitted that the petitioner had been serving as a district and sessions judge (D&SJ) when on February 19, 2011 he was appointed as a judge of the accountability court for three years.


He said that though the petitioner retired on April 20, 2012 as a district and session judge, Section 5-A of the NAB Ordinance allowed him to complete his tenure as a judge of the accountability court.

The counsel said that on May 24, 2012, the government had entrusted additional charge of Shafi’s court to another accountability court judge. He described the government notification as “against the law”.

He submitted that under the Supreme Court judgment in the Asfand Yar Wali case, the petitioner was entitled to complete his tenure as an accountability court judge. He also requested that the “illegal” notification be suspended till the court decides the matter.
