Ceramics shop sued over tile work
Respondent says fulfilled deal, petitioner still owes him for tiles.
LAHORE:
A consumer court on Monday issued notice to the proprietors of Sher Rabbani Decorations for June 18 in a suit seeking damages of Rs2,663,260 from the ceramics shop for failing to provide tiles or completing tiling work in a house.
Petitioner Major (r) Jalil Usman submitted that he ordered wall and floor tiles from the respondents on February 25. He said that he agreed to pay a total of Rs40,100 for the tiles and Rs15 per square foot to the worker, and the respondents pledged to complete the work in seven days. He paid Rs20,000 for the tiles in advance.
Usman said that the shop supplied some tiles initially, but soon stopped it. A few days into the job, he said, the worker began showing up late. He said when he complained, the respondents demanded more money for the tiles. He said he paid them another Rs5,000 for the tiles and Rs9,200 to the worker. Still, he said, the tiles were not supplied and the worker did not finish the job. He said that he then had to buy more tiles and get the job done from another place.
The petitioner asked the court to direct the shop to pay him Rs1.5 million in damages, Rs500,000 for failing to supply the tiles, Rs500,000 for providing defective services, Rs34,200 for the amount he had paid for the tiles and worker, Rs40,000 for the loss of cement wasted in the job, Rs49,060 for the money he had paid to get the job done by someone else, as well as Rs40,000 as his lawyer’s fee.
Bashir Ahmed, who runs the shop, denied the allegations. Speaking to The Express Tribune, he said that they had supplied Rs40,000 worth of tiles to the petitioner. He said when he had demanded the rest of the payment, the petitioner had mistreated the worker and his helper, threatened them and kicked them out of the house. Ahmed said he had later contacted Major (r) Usmani over the phone to sort out the problem, only to be told that the petitioner was filing a case against him.
