Penal code: Petitioner redirected to magistrate
Petitioner said his servant came into his room carrying a kettle and threw boiling water badly hurting him.
LAHORE:
An additional district and sessions judge on Wednesday disposed of a petition seeking the addition of the charge of attempted murder to an FIR, directing the petitioner to approach the area magistrate as that was the appropriate forum for his plea. Petitioner Major (retired) Tahir Majeed told the court that on March 25, his servant Abdul Aziz came into his room carrying a kettle and threw boiling water on him, badly hurting his hands and face. He said that Aziz had tried to kill him and also made death threats. He said that he lodged a complaint at Defence-B police station, who registered a case under Sections 506 (criminal intimidation) and 337F(i) (punishment for ghayr-jaifah) of the Pakistan Penal Code. He said that Aziz had tried to kill him and asked the station house officer to add Section 324 (attempted murder) to the FIR, but he refused. At the last hearing, the SHO told the court that the offence had been classified under Section 337F(i) on the recommendation of the medical examiner who compiled the medico-legal report. He said that there was no evidence for the inclusion of an attempted murder charge.
