LAHORE:

Additional District and Sessions Judge Tahir Khan Niazi on Thursday again issued notice to the Sabzazar station house officer and directed him to produce the child at the centre of an acrimonious custody battle in court on January 18 after recovering him from his mother, PML-Nawaz MPA Deeba Mirza.

The MPA and her ex-husband Mirza Abdul Waheed Baig have filed various petitions against each other. The MPA first filed a suit for the recovery of dowry in the family court of Muhammad Ali. Baig later filed a suit in a civil court seeking a direction to the National Database and Registration Authority (NADRA) that the birth certificate for Deeba’s daughter Ayesha, in which Baig is named as the father, be declared void.

He also filed a suit in a guardian court seeking custody of their son Sher Afgan as well as the petition seeking his recovery.

Baig’s counsel Advocate Rao Salahuddin told Judge Niazi that the MPA had abducted Sher Afgan when he was on his way home from school on December 15.

He said his client had approached the respondent to ask she return their son, but she had refused. He said Sher Afgan was being illegally detained and his life was in danger. In earlier proceedings, the judge had issued notice to the SHO Sabzazar for January 5.

On Thursday, Assistant Sub Inspector Muhammad Zufiqar submitted a report to the judge on the SHO’s behalf stating that Deeba Mirza was refusing to comply.

The judge again issued a direction to the SHO to bring the child to court on January 18.

In the civil suit, Civil Judge Muhammad Asif again issued notice to Deeba Mirza to respond by January 24 to Baig’s petition that she had, through fraudulent means and in connivance with the NADRA deputy manager, had him registered as father of Ayesha Mirza when he was not her father. He asked the court to declare her birth certificate null and void.

Also on Thursday, the guardian judge issued notice to Deeba Mirza for January 14 on Baig’s petition seeking interim custody of Sher Afgan.
