Habeas Corpus: Judge tells DIG to produce ‘illegally detained man’

Petitioner Zarina Bibi had filed a habeas corpus plea for the recovery of her children from police custody.

District and Sessions Judge Mujahid Mustaqeem Ahmed has directed the deputy inspector general (operations) to produce Muhammad Sarwar alias Shera in court on Thursday (today), though police have denied they are holding him in custody.



Petitioner Zarina Bibi had filed a habeas corpus plea for the recovery of her son Sarwar, his wife Nadia and their two-year-old son Abdullah from police custody. Sarwar had been convicted in absentia by an anti-terrorism court on April 9, 2011, and him and his brothers Rafaqat and Kashif had been declared absconders.

She said that the Badami Bagh station house officer, Kotwali Superintendent of Police Umer Virk, Kotwali Deputy Superintendent of Police Riaz Shah and Crimes Investigation Agency Assistant Sub-Inspector Muhammad Shakil Butt had raided her home on December 22 and took away Sarwar, Nadia and Abdullah.
