Non-payment of dues: IHC seeks reply from CDA boss

Petition filed in IHC by a private land developer for the early recovery of its dues.

The Islamabad High Court (IHC) on Monday issued notice to the civic authorities on a petition filed by a private land developer for the early recovery of its dues.


IHC Chief Justice Iqbal Hameedur Rehman sought a reply from CDA Chairman Imtiaz Inayat Elahi on a petition filed by Multi-Professional Cooperative Housing Society (MPCHS) seeking recovery of Rs2.03 billion that the CDA owes to the housing society.

The counsel for MPCHS, Muhammad Aslam, maintained that the society was supposed to pay the amount within 15 days of the notice the society had sent to CDA. After the lapse of the 15-day period, the total amount with interest has increased to Rs2.14 billion, the petitioner claims.


He informed the court that MPCHS was allowed to claim a legal remedy over the investment that it had made in the project and a neutral commission was formed by the civic agency to look into the matter.

The housing society demanded that the investment be reimbursed to it. The CDA also formed a commission to resolve the dispute, which suggested an audit of the claim by an internationally recognised auditing firm.

The lawyer argued that the auditing firm imposed an unjust tax of Rs1.64 billion on the verified claim.

He stated that his client had worked honestly on the project therefore, dues should be reimbursed to it without the imposition of any taxes.
